The Recreation Ground Trust’s appeal was heard yesterday by the Upper Tier Tribunal (UTT) at the Royal Courts of Justice, presiding were Mr Justice Warren and Judge McKenna.

The appeal was against the legal analysis that underpinned some of the changes made to the Charity Commission scheme by the First Tier Tribunal (FTT) in March 2014, these changes significantly limit the Trustees ability to run and manage the Recreation Ground to further the charitable objectives.

While no timetable was given for a decision it is hoped that the judgement will be handed down within a few weeks. If the appeal is upheld it is expected that the Scheme will be remitted back to the FTT for further amendment with directions from the Judges presiding today.

Liz Bloor said: “We can’t predict the outcome from today. All parties were given a fair hearing and we are hopeful that the Upper Tier Tribunal will accept the arguments put forward on our behalf and will recognise the need for a clear framework in which the Trustees can work to realise the full potential of Bath Rec for the widest range of users.”
